PODWAY TERMS OF SERVICE

Introduction

Hello and welcome to Podway!

Please carefully read these Podway Terms of Service along with any referenced additional terms and policies (collectively "Podway Terms"). The Podway Terms constitute a legally binding agreement between you ("you") and the provider, Podway (Business ID: 3479025-8) ("Podway"). They govern your access and right to use the personal service, which includes podcasts and other content, related applications, and any other materials provided by Podway from time to time (collectively "Podway Service").

You agree that the Podway Service is available only to individuals who (i) are at least 18 years old or between 13-18 years old with parental consent, (ii) can enter into a legally binding contract with Podway, without restrictions under applicable law, (iii) reside in a country where Podway Service is available, and (iv) use the Podway Service for private, non-commercial purposes.

By accepting the Podway Terms and/or using or accessing the Podway Service, you confirm you meet the above conditions and have entered into an agreement with Podway.

Changes to Podway Terms

Podway may occasionally modify the Podway Terms for valid reasons, such as changes in service functionality, technological developments, or legal requirements. If changes are significant, Podway will notify you and/or seek your consent appropriately. If you do not agree with the changes, do not continue to use the Podway Service. Continuing use after notification constitutes acceptance of the modified terms. To terminate your Podway account due to changes, email customer service at asiakaspalvelu@podway.fi or delete your account via the service settings. If you have a free trial or paid subscription through a third party, you must cancel through that third party.

Podway Service

To use Podway Service, you must create a password-protected account ("Podway Account"). You guarantee that provided information is accurate and up-to-date. You agree not to share your account or password with others and are solely responsible for all activities on your Podway Account (including unauthorized use). Notify Podway immediately if you suspect unauthorized use and change your password as soon as possible. Podway is not liable for actions conducted through your account unless caused by Podway's own negligence.

Membership and Fees

The free version of the Podway Service provides access to certain content, features, and functionalities. Certain Premium content, features, and functionalities ("Membership") require a monthly or other equivalent paid subscription.

You may purchase Membership directly from Podway or via third-party services, such as Apple App Store. Subscriptions purchased via third parties are subject to their terms. Podway Service content becomes accessible immediately upon registration. Podway is not responsible for any charges or fees your banks or credit card companies may impose.

If you purchase Membership, you authorize Podway (or the third party) to automatically charge your selected payment method monthly or according to the subscription terms agreed. Your subscription will automatically renew at the end of each billing cycle. To prevent automatic renewal, cancel 24 hours before the current billing cycle ends. Cancellation takes effect at the end of the current subscription period.

You can cancel Membership directly purchased from Podway via account settings. For third-party purchases, cancel through the respective third-party service.

Podway reserves the right to change subscription content or pricing occasionally, including regular fees or prepaid periods. Podway will inform you in advance of any price changes. Continued use after price changes constitutes acceptance. If you disagree with price changes, terminate Membership before the change takes effect.

Trial Periods

Podway may offer free or discounted trial periods ("Trial Period"). Podway reserves the right to determine Trial Period terms and cancel or modify them anytime, within legal limits, without liability.

Certain trials require providing payment details. By providing payment details, you agree Podway may begin charging after the Trial Period (e.g., monthly), as stated in trial terms. To avoid charges, cancel before the trial ends through Podway account settings or third-party service if applicable.

Use of Podway Service

The Podway Service and associated intellectual property rights belong to Podway or its licensors. Podway grants you a limited, non-exclusive, revocable, non-transferable, and non-sublicensable right to use Podway Service strictly for personal and non-commercial purposes. You agree not to share, copy, or distribute Podway Service or its content.

You acknowledge the Podway Service is accessible only in countries where the service is available, with content varying by geographic location. Other than explicitly granted rights, Podway does not grant any ownership or interest in the Podway Service or its content.

Rights Granted to Podway

In exchange for rights granted by Podway, you acknowledge Podway may present advertisements and other information within the service. Podway's content (e.g., podcasts) may include advertisements and is published as provided.

Feedback and Unsolicited Ideas

If you provide Podway with feedback, ideas, or suggestions ("Feedback"), you acknowledge Feedback is non-confidential and Podway may freely use it without compensation to you. Podway does not accept unsolicited ideas or materials concerning service content and is not liable if content is similar to your submitted ideas or materials.

Limitations and Changes

Podway aims to keep the service operational but reserves the right to temporarily or permanently modify or discontinue service features without liability. If prepaid Membership ends prematurely due to permanent discontinuation, Podway refunds the prepaid portion. You understand service content varies over time and may be removed without notice.

You must use compatible devices to access the service and are responsible for internet or data charges.

Third-party Rights

The Podway Terms grant no rights to third parties unless explicitly stated.

If using Podway's iOS app, you acknowledge Apple's limitations and liabilities according to the terms outlined.

Content and Third-party Links

Podway is not responsible for the accuracy, currency, or usefulness of information presented (e.g., in podcasts). Using content is at your own risk. Podway disclaims liability for direct or indirect damages resulting from content inaccuracies.

Personal Data

Podway's Privacy Policy applies to your use of Podway Service.

Termination

Podway Terms are effective until terminated by you or Podway. You may terminate via customer service or account deletion. Podway may suspend or terminate access at its discretion. You have a statutory right to cancel within 14 days of registration unless digital content has been accessed.

Applicable Law and Dispute Resolution

Podway Terms and disputes are governed by Finnish law, and disputes handled in Helsinki District Court.

Liability Limitations

You acknowledge your sole remedy for dissatisfaction is service termination. Podway is not liable for indirect damages exceeding amounts paid within the past 12 months or claims not made within one year of occurrence.

Class Action Waiver

Claims must be presented individually; class or representative actions are prohibited.
